UAE Tax Residency Certificate 2026: The Three Residency Tests, the Treaty Trap, and How to Apply
Spending 90 days in the UAE can put you on the right side of one domestic residency test. It can also leave you with the wrong assumption about treaty relief.
A residence visa, a home in the UAE, and enough days in the country do not, by themselves, answer every tax-residency question.
That matters when you need a UAE tax residency certificate. The FTA’s current TRC service separates applications made for Double Taxation Agreement purposes from those made for other reasons, and the treaty itself may change the analysis. Visa status is another separate issue, as explained in our UAE Green Visa and tax residency guide.
So before asking how to get a tax residency certificate in UAE, work out which test you meet, and what you need the certificate to do.
That is where the real analysis begins.
What is a UAE Tax Residency Certificate, and which type do you need?
A UAE tax residency certificate is an official document issued by the Federal Tax Authority (FTA) confirming that a person qualifies as a UAE tax resident for the period stated on the certificate. Individuals and juridical persons can apply, provided they meet the rules relevant to their circumstances and the purpose of the application.
That purpose matters more than it may first appear.
The FTA currently distinguishes between a tax residency certificate requested for the application of a Double Taxation Agreement (DTA) and one requested for other purposes.
A treaty application has to be considered against the residence provisions of the relevant DTA; a non-DTA application is assessed under the UAE’s domestic tax-residency framework.
A UAE residence visa, meanwhile, does not by itself make someone a UAE tax resident. Immigration status may form part of the evidence, but the tax tests must still be met.
Corporate Tax residency is related, but it is not interchangeable with every TRC test. The next question, then, is which residency rules apply to your particular application.
DTA-purpose TRC vs TRC for other purposes
The reason for obtaining a UAE tax residency certificate determines which rules the FTA will apply. Its current TRC service separates applications made under a Double Taxation Agreement from those made for other purposes.
For a DTA-purpose TRC, the starting point is the relevant treaty. Under Ministerial Decision No. 247 of 2023, the applicant must meet the UAE tax-residency conditions contained in that international agreement. Domestic rules may still matter where the treaty relies on them.
For other purposes, the analysis stays within the UAE framework. Cabinet Decision No. 85 of 2022 provides the core residency rules, read with Ministerial Decision No. 27 of 2023 for natural persons.
Here is a quick comparison of DTA-purpose and non-DTA TRCs, showing what each is used for, the rules that apply, and the key eligibility differences:
| Question | DTA-purpose TRC | TRC for other purposes |
| What is it used for? | Applying provisions of a relevant DTA | Proving UAE tax residency for another purpose |
| Governing test | Residence conditions in the relevant DTA | UAE domestic residency rules |
| Natural-person rules | Treaty-specific, with domestic rules relevant where the DTA refers to them | Cabinet Decision No. 85 of 2022, read with Ministerial Decision No. 27 of 2023 |
| Treaty jurisdiction required? | Yes | No |
| Additional treaty evidence? | May be required | Generally based on domestic residency evidence |
| Does meeting a domestic test settle eligibility? | Not necessarily | Generally, subject to satisfying the applicable criteria and FTA review |
That distinction is important before looking at the three individual residency tests: those tests establish domestic UAE residency, but they do not by themselves answer every treaty question.
Individuals: the three tests for UAE domestic tax residency
For individuals, UAE domestic tax residency is determined under Cabinet Decision No. 85 of 2022, read with Ministerial Decision No. 27 of 2023. You do not need to satisfy all three routes. Meeting any one of them can establish UAE tax residency for the relevant 12-month period.
Test 1: Physical presence for 183 days or more
This is the most straightforward route. If you are physically present in the UAE for at least 183 days during a consecutive 12-month period, you can qualify as a UAE tax resident under this test. The days do not need to run consecutively, and even part of a day counts as a full day. What you were doing in the UAE during those days does not change the result.
The FTA explains these day-counting rules in its Tax Resident and Tax Residency Certificate Guide.
Test 2: The conditional 90-day test
This is where the rules become more specific. Spending 90 days in the UAE is not enough on its own.
You must spend at least 90 days in the UAE during the relevant 12-month period and be a UAE or GCC national, or hold a valid UAE Residence Permit. On top of that, you must either have a Permanent Place of Residence in the UAE or carry on employment or a Business here.
For someone considering a UAE tax residency certificate, that distinction is important: 90 days is only one part of the test.
Test 3: Usual or primary residence and centre of financial and personal interests
The third route does not depend on a fixed statutory day threshold. Instead, both your usual or primary place of residence and the centre of your financial and personal interests must be in the UAE.
The assessment looks at the substance of your life: where you normally live, where your family and social connections are strongest, where you work or conduct business, and where significant financial interests are located or managed. No single factor decides the outcome; the strength and importance of the connections matter.
Exceptional circumstances and day counting
There is one further safeguard. Under Ministerial Decision No. 27 of 2023, days spent in the UAE because of qualifying exceptional circumstances are disregarded when applying the physical-presence tests.
This can include an unforeseen event, such as a serious medical emergency or border closure, that prevents a person already in the UAE from leaving as planned.
| Test | Physical-presence requirement | Additional conditions | Typical evidence | Domestic residency possible? |
| 183-day test | 183 days or more | None under this day-count test | Passport/Emirates ID and official entry/exit report | Yes |
| Conditional 90-day test | At least 90 days | UAE/GCC nationality or valid UAE Residence Permit, plus a Permanent Place of Residence or employment/Business in the UAE | Entry/exit report and supporting residence, employment or business evidence | Yes |
| Usual/primary residence + centre of interests | No fixed statutory day threshold | Both limbs must be satisfied | Residence, personal, employment/business and financial evidence | Yes |
These three tests answer the domestic residency question. They do not necessarily answer the treaty question—and that is where the 90-day rule can become misleading.
The 90-day treaty trap: why domestic residency does not automatically mean treaty residency
Meeting the UAE’s conditional 90-day test can establish domestic tax residency, but it does not automatically establish treaty residency. For a treaty-purpose TRC, the relevant Double Taxation Agreement (DTA) must still be reviewed.
Domestic tax residency vs treaty residency
Domestic residency is determined under UAE law. Treaty residency is determined under the relevant DTA, which may refer back to domestic rules or impose additional conditions. Ministerial Decision No. 247 of 2023 and the FTA’s TPGTR1 guide both require the treaty position to be considered case by case.
What if you are resident in two countries?
Where dual residence arises, the treaty may consider factors such as permanent home, centre of vital interests, habitual abode or nationality. Some cases may require competent-authority resolution.
A simple example
An executive who spends 105 days in the UAE, holds a valid residence visa and maintains a permanent home here may satisfy the domestic 90-day test. But if a UAE tax residency certificate is needed to claim treaty relief, the relevant DTA must still be reviewed before treaty residency or treaty benefits can be concluded.
Companies: when can a juridical person qualify as a UAE tax resident?
Under Cabinet Decision No. 85 of 2022, a juridical person incorporated, formed or recognised under UAE law is generally a UAE tax resident for domestic purposes. This also applies to UAE Free Zone companies, although tax residency, Qualifying Free Zone Person status and treaty entitlement are separate issues.
A foreign-incorporated company may also be UAE resident for Corporate Tax purposes if it is effectively managed and controlled in the UAE. A UAE branch of a foreign company is different: it is not a separate legal person, so the head office and the relevant treaty must be considered.
A Corporate Tax TRN is not universally required for a UAE tax residency certificate. The FTA Service Card lists it as “if available”, although having one reduces the certificate fee. Newly established companies must also have been established for at least 12 months before applying for a TRC.
What is a UAE Tax Residency Certificate used for?
A tax residency certificate is mainly used when a person or company needs formal evidence of UAE tax residence. That may be for a foreign tax authority, a bank, or another institution reviewing the applicant’s tax position.
For treaty purposes, the certificate can support claims under an applicable Double Taxation Agreement, including relief connected with dividends, interest, royalties or other treaty-covered income. Our guide to UAE Double Taxation Agreements explains that mechanism in more detail.
The certificate itself does not guarantee a lower foreign withholding-tax rate. It establishes evidence of residency for the stated period; the actual treaty benefit still depends on the relevant DTA and the underlying transaction.
When can you apply for a UAE Tax Residency Certificate?
Timing depends on who is applying. The FTA’s current Tax Residency Certificate service allows a natural person to apply once the relevant residency conditions have been met. A juridical person can apply three months into the selected period, while Government and Government Controlled Entities can apply from the first day.
| Applicant | Earliest current-period application |
| Natural person | Once the applicable residency criteria are met |
| Juridical person | After 3 months into the period |
| Government/Government Controlled Entity | From day 1 of the period |
| Newly established company | Only after being established for 12 months |
A UAE tax residency certificate may cover a current or previous Tax Period, or another selected period of up to 12 months. It cannot be issued for a future period or for more than 12 months.
What documents do you need for a UAE Tax Residency Certificate?
There is no single document list for every application. What the FTA expects depends first on whether the applicant is an individual or a juridical person, and then on whether the certificate is needed for DTA or non-DTA purposes.
| Applicant | Purpose | Core documents | Additional evidence |
| Natural person | Non-DTA | Emirates ID/passport and official entry/exit report, with documents relevant to the residency test relied upon | Residence, employment/business, income or personal/financial-interest evidence as applicable |
| Natural person | DTA | Passport, Emirates ID where applicable, official entry/exit report and UAE income/salary evidence where relevant | Evidence required by the relevant DTA |
| Juridical person | Non-DTA | Valid licence, lease, certificate of incorporation, MoA, authorised-signatory documents and CT TRN if available | Effective management and control evidence where applicable |
| Juridical person | DTA | Corporate licensing and constitutional documents, authorised-signatory evidence and CT TRN if available | Treaty-specific and management/control evidence where applicable |
The FTA’s August 2026 Service Card is the current reference where its requirements differ from the older Procedures Manual.
Why the entry and exit report matters
For individuals relying on a day-count test, the official entry and exit report is central evidence because it supports the actual period of physical presence in the UAE. The FTA accepts reports issued by the Federal Authority for Identity, Citizenship, Customs and Port Security or the relevant local competent authority.
Are bank statements still required?
Bank statements are not listed as a standard document for every application in the August 2026 Service Card. That does not make financial evidence irrelevant. Where the application depends on the person’s centre of financial and personal interests, or the FTA asks for further support, such evidence may still become important.
How to apply for a UAE Tax Residency Certificate through EmaraTax
The application runs through EmaraTax. The process is straightforward, but the certificate purpose, treaty country, and requested period must match the evidence you submit.
- Go to the EmaraTax portal.
- Use an existing account, create one, or link an old Tax Certificate account.
- Open “Other Services”.
- Select “Tax Residency Certificate”.
- Choose the applicant’s Corporate Tax TRN, if available; otherwise select “No Tax Registration Number”. A CT TRN reduces the FTA fee.
- Choose DTA purposes or another purpose. For a DTA application, select the relevant treaty country.
- Complete the application, select the eligible period and upload the supporting evidence. You may also request a printed certificate or International Form attestation.
- Pay the application and review fees.
- Submit the application.
- Once approved, download the certificate from EmaraTax. It is also sent to the registered email address.
What if the foreign tax authority requires its own residency form?
The FTA can attest an International Form issued by another jurisdiction. It must be completed and signed before submission; a juridical person must also stamp it. The country and 12-month period must match the related TRC. A scanned form can be uploaded, while a physical form may be sent by courier.
How much does a UAE Tax Residency Certificate cost, and how long does it take?
As of August 2026, the FTA charges are:
| Fee | Amount |
| Submission fee | AED 50 |
| Electronic TRC — applicant with CT TRN | AED 500 |
| Natural person without CT TRN | AED 1,000 |
| Juridical person without CT TRN | AED 1,750 |
| Hard copy | AED 250 per copy |
These charges are separate from professional fees and are non-refundable if the application is rejected.
Current FTA processing time
A completed tax residency certificate application is processed within 10 business days. A hard copy takes another five business days after payment. An International Form requiring FTA attestation has a 10-business-day processing time from receipt of the completed form and payment.
These timelines assume the application is complete; clarification requests can extend the actual turnaround.
Common reasons UAE TRC applications are delayed, returned or rejected
Most problems start with a mismatch: the application says one thing, while the evidence supports another. The FTA’s current TRC requirements make the certificate purpose, period, and supporting documents central to the review.
Common issues include:
- choosing DTA instead of non-DTA purposes,
- claiming a day count that does not reconcile to the official entry/exit report,
- or relying on the 90-day route without proving the additional residence,
- employment,
- or business condition.
- Treaty applications can also stall when treaty-specific evidence is missing.
International Forms have their own traps. The country and period must match the related TRC, and the form must be completed, signed and, for juridical persons, stamped where required.
For companies, applying before the 12-month establishment condition is met will also prevent eligibility.
ADEPTS reviews these points before submission to reduce avoidable return queries.
TRC vs Tax Domicile, Tax Registration and Clearance Certificates
If you search tax certificate UAE, you will find several documents serving very different purposes. Tax domicile certificate UAE is commonly used as another label for the UAE TRC, rather than a separate current FTA residency category.
| Term | What it shows | Same as a TRC? |
| Tax Residency Certificate | UAE tax residency for the stated period | Yes |
| Tax Domicile Certificate | Common alternative terminology for a TRC | Generally, yes |
| Tax Registration Certificate | Registration for a UAE tax and the related TRN | No |
| Clearance Certificate | No pending FTA liabilities in the applicable clearance process | No |
For registration, see our Corporate Tax Registration Guide. The FTA separately explains its Clearance Certificate service.
What changed in UAE Tax Residency Certificate requirements in 2026?
The important change came in August 2026.
The FTA updated its TRC Service Card and states that, where it differs from the older Procedures Manual, the updated Service Card prevails until the manual is revised.
It also sets out the current fees, 10-business-day processing time, and separate documentation requirements for DTA and non-DTA applications. For a current application, these rules should take priority over older guidance found elsewhere.
How ADEPTS handles a UAE Tax Residency Certificate application
ADEPTS starts with the question that matters most: what does the certificate need to prove?
From there, we review the domestic residency position, the relevant DTA where applicable, day counts, and supporting evidence before preparing the EmaraTax application.
For companies, the review can extend to effective management and control. We can also assist with FTA queries, International Forms and treaty-relief analysis where the facts require it.
The practical point is simple: domestic residency and treaty residency should not be treated as interchangeable tests.
Conclusion
Before applying for a UAE tax residency certificate, pin down four things: the period you need certified, whether the application is for DTA or other purposes, the residency test you rely on, and the evidence supporting that same period.
For treaty claims, add one final check: does the relevant DTA actually treat you as a UAE resident for the benefit being claimed?
If that answer is unclear, have the position reviewed before the TRC application is filed.
FAQs:
By meeting at least one UAE domestic residency test: the 183-day test, the conditional 90-day test, or the primary-residence and centre-of-interests test.
As of August 2026, the FTA charges AED 50 to submit the application, plus a certificate fee based on applicant type and Corporate Tax TRN status.
It provides official proof of UAE tax residency and can support treaty claims, foreign tax filings and withholding-tax relief applications.
Potentially, but 90 days alone is not enough. The additional residence, employment or business conditions must also be met.
In UAE practice, “Tax Domicile Certificate” is commonly used as another term for a Tax Residency Certificate rather than a separate FTA certificate.
No. A TRC cannot be issued for a future period; it can cover only an eligible current or previous period of up to 12 months.
Not always. They are not a universal requirement, although financial evidence may still be relevant depending on the residency test and facts.
Yes. A UAE Free Zone company can qualify, provided the applicable residency and application conditions are satisfied.
It covers the specific period stated on the certificate, up to a maximum of 12 months.
