UAE E-Invoicing Deadline Stays as MoF Eases Three Rules
Dubai, 20 October 2026 – Three UAE e-invoicing rules have been relaxed, but the e-invoicing deadline stays where it was.
The Ministry of Finance (MoF) announced Ministerial Decision No. 197 of 2026 on 19 October, although the decision has been in effect since 1 October. It amends Ministerial Decision No. 243 of 2025, and the go-live date is still 1 January 2027.
Ministerial Decision No. 197 of 2026 Amends Three Core E-Invoicing Rules
The Ministry of Finance said that the amendments aim to provide businesses with greater clarity and reduce operational burdens ahead of the UAE’s e-invoicing rollout. The changes address key areas, including transactions between Tax Group members, e-invoice data storage requirements, and procedures for handling system failures. The full decision text is on the ministry’s website, and ADEPTS’ guide to UAE digital invoicing covers the wider framework.
Intra-Tax-Group Transactions Sit Outside the E-Invoicing System Until December 2028
24-Month Exclusion From 1 January 2027 for VAT Tax Group Members
Under Ministerial Decision No. 197 of 2026, transactions between members of the same VAT Tax Group will be excluded from mandatory e-invoicing requirements for 24 months, from 1 January 2027 to 31 December 2028.
This applies to businesses registered with the Federal Tax Authority (FTA) as a single taxable person. The exclusion gives Tax Groups additional time to update their internal invoicing processes and systems. However, transactions with parties outside the Tax Group remain subject to the applicable e-invoicing requirements.
Voluntary Use of the System and the Penalty Carve-Out
Businesses can still issue e-invoices for excluded transactions if they choose to. The e-invoicing rules then apply to those transactions in full, except the provisions on violations and administrative penalties. ADEPTS has covered how VAT group members connect to an Accredited Service Provider.
UAE Data Localisation Requirement Removed for E-Invoice Records
The amended Article 11 no longer requires e-invoice data to be stored inside the UAE. Anyone subject to the system must keep e-invoices, e-credit notes and associated data for the period set by the Tax Procedures Law, and be able to hand them to the FTA on request. The ministry clarified that the focus is now on ensuring records are properly maintained and accessible, rather than requiring them to be stored in a specific location.
System Failure Notification Duty Repealed With Article 12
Article 12 is gone, and the definition of “System Failure” went with it.
Under the old rule, a business had two business days to report an outage to the FTA, and that duty no longer exists.
Status of the AED 1,000-per-Day Penalty Under Cabinet Decision No. 106 of 2025
The fine attached to that duty is a murkier matter. Cabinet Decision No. 106 of 2025 put a price of AED 1,000 a day on late notification of a system malfunction. MoF’s announcement says nothing about it, so it’s worth asking the FTA where that penalty now stands. ADEPTS’ note on UAE e-invoicing penalties under Resolution 106 lists the full schedule.
E-Invoicing Deadlines That Remain Unchanged
The amendments don’t touch the main dates. Businesses with annual revenue above AED 50 million must appoint an Accredited Service Provider (ASP) by 30 October 2026 and be live by 1 January 2027, a timeline the ministry reaffirmed in May.
ADEPTS’ guide for large taxpayers covers that first wave. Smaller businesses follow on 1 July 2027 and government entities on 1 October 2027, under the wider UAE e-invoicing timeline.
Direct ASP Accreditation Under Ministerial Decision No. 168 of 2026
Separately, Ministerial Decision No. 168 of 2026 took effect on 1 October and replaced the pre-approval stage for service providers with direct accreditation, the ministry said on 9 October. Providers that held preliminary approval have up to 30 days from 1 October to meet the new requirements, or the approval ends. The change sits inside the four-corner e-invoicing model.
What Businesses Should Do Now
Companies in a Tax Group should map their intra-group invoice flows and check ERP settings before 1 January 2027. Everyone else should revisit ASP contracts, along with any data hosting terms written around the old UAE storage rule. A VAT health check is a practical way to test both.
The rules have loosened at the edges, but the e-invoicing deadline hasn’t moved.
ADEPTS Helps Businesses Align E-Invoicing Readiness With the Amended Rules
ADEPTS works with UAE businesses on the practical side of the amended rules. That covers reviewing Tax Group membership and intra-group invoice flows, checking how ERP settings treat excluded transactions, and going through Accredited Service Provider contracts and data hosting terms before the 1 January 2027 go-live.
For a first read, the free E-Invoicing Readiness Score tool shows where a business stands today.
Companies that want hands-on support can start with ADEPTS’ e-invoicing services, which run from scoping Tax Group flows to choosing an ASP. With the 30 October appointment deadline ten days away for businesses above AED 50 million, it’s worth getting in touch sooner rather than later.
